Frequently Asked Questions
What is a CDFA®?
A Certified Divorce Financial Analyst® is a financial professional who specializes in the financial issues concerning divorce. This includes acting as an advisor to one party’s divorce lawyer, or as a mediator for both parties. A CDFA® uses their knowledge of tax law, asset distribution, and short and long-term financial planning to strive for an equitable settlement.
CDFA® professionals have met specific education, experience and ethical requirements, and have been designated by the Institute for Divorce Financial Analysts (IDFA). To learn more, visit institutedfa.com.
How are you different from an attorney?
While an attorney is able to give you legal advice, prepare, and file your divorce documents, a Certified Divorce Financial Analyst® is equipped to help you understand the financial assets and the implications your settlement may cause. But it goes beyond that, we partner with other professionals, including attorneys, to make sure that your settlement covers all aspects of your life.
In cases of amicable dissolution, you may even be able to avoid the courtroom with the aid of a CDFA®. Call us today to learn more about why working with a CDFA® may be favorable.
Do I still need an attorney?
It really depends on your unique situation. A Certified Divorce Financial Analyst® is able to bring value to any divorce regardless of your choice to use an attorney or not. Our expertise is in your financial health and we can work with you or your attorney to understand your financial options and implications in crafting a fairer divorce settlement.
Is this mediation?
No. Our expertise is in bringing understanding and expert analysis to your financial situation. We provide recommendations and work with you and your attorney to craft a fairer divorce settlement. In certain circumstances, couples are able to finalize their divorce with the financial expertise of a CDFA®. We also work with and can recommend other professionals such as mediators if you choose to move in that direction.
Are you able or available to appear in court?
Yes. Our Certified Divorce Financial Anaylsts® are equipped and experienced to appear in court as financial experts in support of your divorce case. We can produce powerful case exhibits in the form of reports and graphical representations to be presented in court.
My spouse has stock options that are not fully vested. How do we split that in a divorce?
Working with a Certified Divorce Financial Analyst® gives you the financial expertise and support needed to understand the value of your financial assets. We work to ensure that you have a comprehensive view of your financial situation and explore your options in negotiating a fair settlement. This expertise is necessary to help you make informed decisions and arrive at a fairer financial settlement you won't regret.
Can we avoid the court all together?
It depends. All divorce cases have to be filed for your marriage to be legally dissolved so technically, you cannot keep your divorce out of the courts. However, if you and your spouse oare able to amicably work out a settlement with your lawyer or mediator, a Certified Divorce Financial Analyst® is able to work with you to craft a financial settlement that may keep your divorce out of a courtroom.
This is not legal advice or a recommendation. Please contact your attorney for recommendations on your unique circumstance.
In what capacity are you able to help me with my divorce?
There are three main ways we support our clients:
Financial Neutral - we work with couples to provide financial expertise and understanding. We work to craft a settlement that is amicable and fair to both parties.
Financial Advocate - we work with an individual (with or without an attorney), to build a case to support their proposed financial settlement and negotiations.
Litigation Support - we work with your attorney to provide financial analysis and expertise needed to support a case that is going to court. We even appear in court if necessary, as an expert witness.
Additional services include pre-divorce financial review or strategic planning, post divorce transition, and post-divorce financial planning to set you up for financial independence after divorce.
